Quebec pool owners are the most regulated buyer cohort in our catalog. The 2025 amendment to the Règlement sur la sécurité des piscines résidentielles tightened an already-strict standard and triggered active municipal enforcement — properties with non-compliant enclosures receive municipal orders, with fines starting at $500 and going up for ongoing non-compliance. The regulation applies broadly: every in-ground pool, every above-ground pool 60 cm deep or more, and (a 2025 amendment) every inflatable pool meeting the same depth criterion.

Compliance spec: enclosure 1.2 m minimum height with no climbable surface (chair, planter, AC condenser, equipment) within 1 m of the exterior face; gate must be self-closing AND self-latching with latch either ≥1.5 m above grade or installed on the pool-side face inaccessible from outside; vertical gaps between pickets ≤10 cm; no horizontal members on the exterior face that could serve as foothold. Loi 322 + RBQ B-1.1 compliance details:

Barrier height: minimum 1.2 m from outside ground to top of barrier. Cannot exceed permitted heights without setbacks.

Vertical members: maximum gap 100 mm between vertical pickets or mesh openings. No horizontal members within 1.2 m of grade that could serve as climbing footholds.

Gates: must be self-closing AND self-latching. Latch height minimum 1.5 m from ground (must be out of reach of children under 5). Latch on the pool side of the gate.

Pool covers: do not exempt from fence requirement. Spas and hot tubs: exempt if covered with locking cover meeting ASTM F1346.

Distance from house: house wall can serve as one side of barrier IF windows are >1.5 m from grade OR fixed (non-opening) OR alarmed window contacts.

Inspection process: pool owners must submit application to municipal building department BEFORE pool installation. Municipal inspector verifies compliance within 30 days post-install. Non-compliance penalties: fines $500–5,000 per violation, plus mandatory remediation.
